The new Complaints Act places serious burdens on companies – they should start preparing immediately

The Parliament adopted the bill on complaints, reports of public interest, and rules related to the reporting of abuses. Companies with more than two hundred and fifty employees must start preparing immediately, as they only have a 60-day grace period to develop their processes in accordance with the regulations, which includes, among other things, the creation of an internet-based abuse reporting system – he calls draws attention to the expert of Saldo Zrt.

On May 23, the Parliament adopted the draft law on complaints, reports of public interest, and rules related to the reporting of abuses, which replaces the Complaints Act adopted in 2013. The law gives the possibility to report workplace abuses and irregularities by name or anonymously, and requires many companies to establish a mandatory abuse reporting system. The legislation is aligned with the EU Whistleblowing Directive: its purpose is to transpose the 2019/1937/EU Directive into the Hungarian legal system, and thereby to regulate notifications related to threats affecting the public interest. The preparation time is short, as some companies only have 60 days to fulfill their obligations, but everyone must set up the abuse reporting system by December 17, 2023 at the latest. The fulfillment of the obligations of the employment supervisory authority and compliance with the data protection rules will be checked by NAIH.
