The main goal remains the abolition of undivided common land ownership

Accelerating the liquidation of undivided common land ownership is still an important goal for the Ministry of Agriculture, with which the Hungarian property policy aims to remedy more than thirty years of debt. In this way, the owner’s attitude can be further strengthened, thereby improving the quality and productivity of the land, which can make Hungarian agriculture more competitive.

Almost half of Hungarian agricultural land is in undivided common ownership, which means more than 2 million hectares. The intention of the co-owners to get rid of this form of ownership is well reflected by the fact that, within the framework of the project aimed at the termination of undivided common property created during the land lease, approximately 250,000 undivided common property applications were submitted to the land offices, which affected 53,500 parcels of land. Today, 90% of the procedures have been completed and the ongoing ones will be completed soon. We are happy to announce that, in the completed procedures, around 230,000 owners have so far received their independent property by designation and transfer of possession.

Since 2021, it has been possible to initiate partition procedures to end such a forced community, based on which around 2,200 procedures have been initiated so far, affecting 29,500 hectares of land. Acquisition by a co-owner was initiated in 1,355 cases, which affects approximately 5,000 hectares. The purpose of the regulations is that, in the case of undivided jointly owned land (including the forest), in accordance with the agreement of the parties, as many of the ownership parts as possible are transformed into independent real estate. In addition to the above – of course – the co-owners still have the possibility to terminate their undivided joint land ownership according to the rules of civil law. In order to successfully liquidate the undivided jointly owned lands and to make the process run as smoothly as possible, the National Land Center, in cooperation with the Ministry of Agriculture, has previously published its informational publication focusing on the topic, the Undivided Joint Sharing Little Book. Starting with the concept of undivided common land ownership, the publication covers the development of this form of ownership and draws attention to how undivided common land can be liquidated as a result of political decisions on land ownership. It highlights the advantages of this process and helps you find out about the smallest details of the sharing process.

The property structure in Hungary can be completely transformed and become more transparent by organizing undivided jointly owned properties

With the development of more usable land areas, the value of the land can also increase, and a more favorable management environment for subsidies and loans can be created. Both the near-completion project aimed at ending the undivided common property created during the partial land lease, and the creation of a form of liquidation based on the agreement of the co-owners will help in this.
