Can fewer HR service providers bring in foreign workers?
Qualified staffing companies had until June 30 to meet the stricter conditions prescribed by the law that came into force at the beginning of the year in order to retain their qualified status. Not all companies were able to meet the amendment of the staffing requirement. These lenders will lose their qualified status until they can meet the new regulations.
Thus, they cannot mediate workers in a simplified procedure, and for the time being they cannot bring new third-country nationals into Hungary either. Several company mergers have taken place on the market, thus ensuring the retention of the benefits of qualified status. However, there are rental companies – including Jobtain – that have managed to fulfill the stricter conditions independently and maintain their qualified status, said Magdolna Mihályi, managing director of the Jobtain HR Service Provider.
The tightening of the law is intended to promote the integration of Hungarian workers
At the beginning of the year, with the amendment of the Immigration Law, the importation of foreign workers became even more regulated than before, the conditions are stricter and those arriving here have to pass even more filters. In addition, the government has tightened up the process of obtaining the status of a qualified labor agency, so it is expected that fewer labor agency companies will be able to bring in workers from third countries in a simplified procedure in the future. Until June 30, the already certified companies had to re-qualify by fulfilling the changed conditions in order to keep their qualified status, which will be reviewed annually from now on. The aim of the changes at the beginning of the year was to promote the labor market integration of around 240,000 people. Furthermore, companies should give priority to Hungarian workers, and if they have to employ foreign workers in their absence, they should do so in a well-regulated legal environment.
