This year, the law on certain issues of the organization of agricultural product markets, the law on producers and the new regulation improves the position of producers vis-à-vis buyers and provides them with stronger protection through legal means. The National Chamber of Agrarian Economy and the Ministry of Agriculture are providing professional information to help those affected to navigate the amendment to the law.
This spring, the law on the organization of agricultural product markets was changed at several points, the purpose of the amendments is to improve the position of producers in the sales chain and provide them with stronger protection through legal means. The elements relating to the conclusion of contracts, data provision and competition law regulations are intended to provide a suitable framework for the sector actors for a more integrated and organized operation. interprofessional organizations. The Product Market Act regulates product sales agreements: pre-harvest contracts, mandatory written contracts, rules for mandatory contracts for fresh or perishable agricultural and food products, as well as producer contracts. In fruit, vegetable, pig and poultry sector contracts, as well as in enterprise-type contracts, the parties must accept risk sharing provisions, in order to ensure that the risks in the value chain are shared proportionately. From now on, late payment can be fined, and it will also be possible to ban the actor who does not pay the price of the product to the producers. By introducing voluntary producer contracts, the amendment of the law places the relationship between producers and producers on a renewed basis, thereby creating more uniform conditions and more stable, regulated and predictable conditions. Most of the amendments will enter into force on January 1, 2025, so that the necessary preparation time is available for the actors involved.
