Information on the requirements for the minimum number of plants and the number of plants in the plantations
During the analysis of the applications for 2023, the Hungarian State Treasury found that when applying for agricultural and rural development subsidies, it was often a problem for agricultural producers to comply with the requirements regarding the minimum number of plants and the number of plants in the plantations.
For all area-based subsidies that can be applied for in a single application, the regulation according to Section 16 c) of AM Decree 15/2024 (IV.9) applies to the number of seedlings in the plantations, according to which, based on the number of seedlings per hectare calculated from the area in the plantation, the missing, dried or the proportion of individuals that have become infertile for other reasons cannot exceed 30%. If this condition is not met, the sign will be rejected, and a penalty will be calculated based on the area of the sign, according to § 34 of AM Decree 15/2024 (IV.9).
However, the eligibility conditions of some forms of support impose demands on farmers that go beyond the 70% capitalization
Regarding the minimum number of plants at the time of planting, there is a requirement in the conditions of the support for extensive and intensive fruit growing. The regulations regarding the minimum number of plants can be found in columns “C” and “D” of Annex No. 4 of the current AM Decree 19/2024 (IV.9), according to which the minimum number of plants per hectare is higher during the intensive fruit subsidy. Furthermore, in addition to the requirement regarding the minimum number of plants at the time of planting, the legislation lists three conditions regarding the maximum age of the plantations, the existence of fixed, installed irrigation equipment, and the number of plants. The plantation must meet at least two of the three conditions. If the plantation exceeds the maximum age according to the regulation, or if it does not have a fixed, installed irrigation system, care must be taken to ensure that the number of seedlings reaches at least 85%. In relation to the legal title, the number of seedlings is nothing but the ratio of individuals capable of bearing fruit in the area and the number of individuals according to the number of seedlings specified in the planting permit – or, in the absence of a planting permit, the number of individuals calculated on the basis of the number of seedlings characteristic of the defining spatial position in the area. In the case of measures aimed at supporting the agri-environmental management program (AKG) and ecological management (ÖKO), the relevant calls for tenders are worded as follows: “In the case of the horizontal plantation thematic group of regulations/plantation land use category, the wood and capital shortage cannot exceed 15%”. So, for plantations participating in the AKG or ÖKO, it is not enough to keep in mind the minimum number of plants of 30% stated as a basic condition! If the percentage of missing individuals still exceeds 15%, the applicant will not receive support for the given year after the table.
