EM: from Monday, a two-level procedure can help in environmental protection authority cases
The goal of the government is to protect Hungary’s natural values and resources, as well as greening the economy and strengthening its circular operation; in order to further strengthen the health of the Hungarian people and the protection of the environment, from July 1st, it will be possible again to have a two-level procedure in environmental protection official cases – the Ministry of Energy (EM) announced on Monday.
According to the ministry’s information, the national second-instance body serves as a preliminary legal remedy forum before the judicial review, once it is established, the second-instance procedure can be conducted within the framework of the state administration.
By conducting the procedures quickly and by examining and settling the necessary technical issues, the authority makes up for the deficiencies of the permits issued at the first level in such a way that it does not lead to the long-term impossibility of investments that are important to Hungary’s competitiveness, they emphasized.
The second-level authority is exercised by an independent deputy state secretariat within the Ministry of Energy. The deputy state secretariat responsible for environmental protection official affairs is responsible for reviewing appeals concerning preliminary and environmental impact assessments, as well as appeals submitted against first-degree permits for integrated environmental use. In addition, in order to establish uniform official practice, it has supervisory powers over first-level environmental protection authorities.
