Does not involve consideration to the webshop in case of waiver clause
The union court stated: In the cases of Internet orders, if the buyer cancels, one should not pay fee for the usage to the seller, despite one used the product before the waiver.
In the specific case; a German buyer bought a used computer throught the Internet, but later withdrew from the purchase. The seller required consideration for the usage of the machinery.
The court stated, that the seller-supplier must refund the purchase price and is not entitled to for the usage price – reports Origo.
