GVH initiated proceedings against Extreme Digital-eMAG
The Economic Competition Authority (GVH) initiated proceedings against Extreme Digital-eMAG Limited Liability Company (eMAG) due to an alleged violation of unfair commercial practices towards consumers. The reason for the procedure was explained in detail by the GVH, according to which eMAG’s practice of publishing consumer opinions, abusing price discounts during promotions, providing untrue delivery deadlines and providing incorrect information about consumers’ 14-day right of withdrawal may be unlawful.
It is important to point out that the procedure does not mean proving the violation of the law, it only aims to clarify the facts and investigate the suspected violation of the law. The GVH had previously investigated eMAG’s promotional practices, as a result of which it ordered the company to pay a significant fine and undertake restitution. However, eMAG did not fulfill its obligations properly, and was therefore fined further.
The GVH procedure must be conducted within three months, but can be extended if necessary.
