Proposed regulation on packaging and packaging waste could pose a threat to seasonal products
Minimising packaging will be the focus in the future, according to a draft proposal ofthe Packaging and Packaging Waste Regulation (PPWR). The Bundesverband der Deutschen Süßwarenindustrie (BDSI), i.e. the German Confectionery Industry Association, has expressed concerns that the EU’s plans could put popular seasonal sweets with decorated packaging, such as chocolate bunnies, at risk.
Unlike the European Parliament, the European Council’s position does not provide for an exemption for seasonal products or gift wrapping. The exemption from the mandatory minimisation of packaging currently only applies to products with a trademark or design copyright. However, according to the BDSI, small and medium-sized enterprises in particular are unable to apply for trade mark or design protection for all their products because of the considerable costs and administrative effort involved.
„For example, the omission of a bow could make a product become ineligible as a gift, as it is this decoration that makes many popular products unique. Under the EU Council’s plans, a special design for a praline box would no longer be possible,” Dr Carsten Bernoth, Executive Director of BDSI said.
The BDSI therefore strongly supports the European Parliament’s position, which takes into account not only the purely protective function of packaging, but also its design for special occasions.
Trilogue political discussions on the PPWR will start today, 5 February 2024.
