HUF 105 Million fine because of Bonux detergent's ad in 2005
According to the court of appeal the competion authority rightly found Procter&Gamble Magyarország Kkt. guilty in bewildering the consumers about Bonux detergent's excellent effect.
Hungary's competion authority (GVH) has
imposed a HUF 315 million fine on Procter & Gamble in September
2006, for misleading consumer with its advertisements between
October-December in 2005.
The GVH concluded that the
advertisements of Procter & Gamble were unlawful for the
following reasons: Procter & Gamble could not prove that its
"Bonux" washing powder is more efficient than other washing
powders in the same price category. Procter & Gamble referred to
the "Ariel test laboratory". This was held to be misleading
because the laboratory, where tests were carried out, did not bear
this name and Procter & Gamble thus unlawfully intended to make a
reference to a higher quality washing powder.
Procter & Gamble went to law, but
on first level its case were dissmissed. The court of appeal said
that the decision of competion authority was rightly, but the fine
were extreme, so it was trisected.
