On the repeated extension of the extension of a market organisation measure
The extension means the legal promulgation of certain internal market organisation measures of the representative interbranch organisation also applicable to undertakings outside the organisation’s membership. According to EU law, the national legislation on the extension of certain market organisation measures is valid for three years, after which it is possible to promulgate the regulation for another three years.
Regulation 8/2017. (III. 2.) FM on the extension of the market organisation measure on the market reporting obligation operating at the Milk Interbranch Organisation and Product Council, then Regulation 4/2020. (II.28.) AM, and subsequently Regulation 21/2023. (IV.28.) AM Decree has been promulgated – in accordance with the detailed rules set out in the legislation and with the data content specified therein – for 9 years now, all milk processors, milk producers, wholesalers and retailers operating in the territory of Hungary dealing with raw milk exports have been obliged to submit market reports.
In view of the expiry of Decree 21/2023. (IV.28.) AM, the Milk Product Council submitted a request to the Ministry of Agriculture to extend the extended provision for another 3 years.
The Ministry of Agriculture – after its consideration as required by law – issued Decree 12/2026 on the extension of the market organisation measure on the market reporting obligation operating at the Milk Interprofessional Organisation and Product Council. (IV. 2.) AM announced the extension of the market reporting obligation until 25 April 2029.
The scope of those required to report remains unchanged, the data provision system will continue to be operated in cooperation with the National Food Chain Safety Office, the AKI Agricultural Economics Institute Nonprofit Ltd. and the Milk Interprofessional Organization and Product Council in the usual manner. The Milk Product Council publishes summary tables prepared from the data providers’ data on its website. Anonymity is ensured, and operators may not disclose any company or individual data from the data reporting system.
Information on the fulfillment of the market reporting obligation, the tables required for submitting reports and completion instructions will also be posted on the Milk Products Council’s website.
The Milk Products Council intends to operate this system in the future in order to protect fair and ethical retail, milk production and milk processing businesses, to assist the authorities in their inspection work, and to maintain a database supporting sectoral strategic decisions.
In the market situation that has characterized the past few months, fresh milk market data from the system are vital.
