MOKK: it is worth making a will about the farmland in advance
If someone has farmland, it is definitely worth making a will about it in advance, as this can prevent disputes between the heirs – the Hungarian National Chamber of Notaries (MOKK) told MTI on Tuesday.
In the announcement, attention was drawn to the fact that the regulation of the inheritance of land has changed since January: while previously a land could be transferred to the heirs as undivided common property, from this year this is only possible temporarily. As of January 1, the heirs must decide on the fate of the land: they can agree on who owns it, sell it, or offer it to the state.
If they cannot reach an agreement within five years, the state will forcefully sell the land, they pointed out
According to the MOKK, all of this can be prevented if the landowner arranges his estate in advance in his final disposition and allocates his land to one of his descendants, while other parts of his property go to others.
“If someone has farmland, it is definitely worth making a will about it in advance, as this can prevent disputes between the heirs. However, when preparing the will, you must also take into account the restrictions on ownership. Due to the complicated regulations, it is worth asking for the help of a specialist, a notary or a lawyer experienced in land matters” – Ádám Tóth, the president of MOKK, was quoted in the announcement.
