The Hungarian Health Authority took action due to misleading health claims

The Hungarian Competition Authority (GVH) has launched three competition supervision proceedings against companies selling food and dietary supplements, as it suspects that the companies are promoting their products with health claims that are unfounded or cannot be sufficiently substantiated, and that they are attributing prohibited medicinal effects to the products.

GVH informed MTI on Friday that the competition supervision proceedings have been initiated against BGB Interherb Élelmiszer Kereskedelmi Kft., Swan Med Hungary Kft. and the Slovenian company Nutrisslim d.o.o.

The competition authority suspects that the companies are engaging in unfair commercial practices, as they use prohibited messages and claims in their communications, with which they unfoundedly try to highlight the health effects of the products, they wrote.

The companies promoted the food and dietary supplements they sold, and in the case of BGB Interherb, cosmetic products, with health claims that did not comply with the relevant industry rules. The companies also attributed or referred to the properties of the products for the prevention, treatment and cure of diseases.

BGB Interherb and Swan Med also promoted some of their products by referring to recommendations from health professionals, which is also likely to be an unfair commercial practice.

Swan Med also used claims for its “DotsDiet” products that suggested that a balanced and varied diet did not provide sufficient nutritional intake, and also likely violated industry rules with its claims about the nutritional composition of the products.

Nutrisslim is likely to use the EU organic production logo and the European Food Safety Authority logo in its commercial communications without authorization.
