Baileys Mini is OK
Europe's highest court ruled U.K. premium drinks business Diageo can continue to sell its liquor in bottles using traditional U.K. measurements.
The case is part of a long-running conflict within the European
Union over units of measurement. Most E.U. countries have agreed to use metric.
But the U.K. claims its right to continue using imperial measures.
The conflict arose over the sale of "Bailey's
Minis" in 0.071 liter, or 71 mL bottles. In imperial measures, that's half
a 'gill', a measurement traditionally used for measuring spirits. A
Schutzverband der Spirituosen-Industrie, a German association that monitors
spirits industry legal compliance, took issue with the German subsidiary of
drinks-producing giant Diageo North America Inc. selling Bailey's in what the
association considered was an illegal bottle size.
The German court referred a legal question to the European
Court of Justice for their interpretation.
