The currently known rules of the extended producer responsibility system would change significantly
On June 19, 2023, a proposal to amend the regulations of the extended producer responsibility system (EPR) was published on the website of the Ministry of Energy, which would fundamentally change the regulations on EPR, which would otherwise be effective from July 1, 2023, with effect from July 1, 2023. Below, the experts of the international business and tax consulting firm Grant Thornton go over the most important points of the EPR proposal.
An unusual legislative situation arose in connection with the EPR. Government Decree 80/2023, introducing the legal institution itself into the Hungarian legal system, on the detailed rules for the operation of the extended producer responsibility system (hereinafter: the “EPR Decree”) was published on March 14, but many of its provisions would only enter into force on July 1. The proposal to amend the rules of the EPR Regulation (hereinafter: “Proposal”) was published on the website of the Ministry of Energy on June 19, and would also partially contain amendments to the EPR Regulation from July 1.
The Proposal clarifies the definition of circular products. Based on this, the EPR payment obligation would not cover consumer packaging that is considered pharmaceutical waste and comes into direct contact with the medicine.
