Energy drinks are now legal: what every shopkeeper should know

New regulations on the sale of energy drinks came into effect on June 11: it is now prohibited to sell energy drinks to those under the age of 18. The Hungarian Energy Drink Association (MESZ) is helping retailers with an updated guide that not only explains the legal background but also summarizes practical information for shopkeepers.

What is an energy drink?

The legislation works with a precise definition. An energy drink is any non-alcoholic beverage that contains at least 15 mg/100 ml of methylxanthine (such as caffeine), or that contains caffeine and any of the following ingredients: ginseng, L-arginine, inositol, glucuronolactone or taurine. The restriction is therefore not based solely on the caffeine content, but also on the combination of the aforementioned ingredients.

What is prohibited:

The biggest brands – such as Red Bull, HELL, Monster, Burn, Watt, Bomba, Adrenalin or the private label Kobra, S Budget, Freeway Up – all fall into this category. These are prohibited from being sold to persons under 18.

What is still allowed:

It is important that the law does not prohibit the sale of other caffeine-containing products – such as coffee, latte, cola, functional drinks (such as Hell NewGen), iced tea or sports drinks – to minors. This may be particularly important information for retailers who want to avoid unnecessary restrictions.

The goal: informed consumers and conscious retailers

The MESZ emphasizes that energy drinks – based on regular inspections by the NÉBIH – are safe foods, and their consumption does not pose a risk to adults. At the same time, the association considers it particularly important that minors receive increased protection. To this end, retailers also have a responsibility to comply with the new rules – and to inform consumers appropriately.

Focus on correct information

The Hungarian Energy Drink Association, in cooperation with the Ministry of Agriculture and the NÉBIH, is presenting the relevant scientific background materials and regulations in an understandable format so that retailers can perform their tasks safely and legally in everyday practice.

Attention retailers: what should you pay attention to?

Ask for the buyer’s ID card if there is any suspicion that they are underage.

Clearly label energy drinks in the store so that they are not mixed with other, non-prohibited drinks.

Educate sellers about the relevant rules, as the penalty may not only affect the store manager, but also sales colleagues.
