The maximum fine that can be imposed by the GVH has been seriously increased – it was announced at the joint conference of the Hegymegi-Barakonyi and Fehérváry Baker & McKenzie Law Firm and the Association of Corporate Counsel Europe. The Competition Authority continues to pay special attention to companies’ price communication, and acts more and more frequently in cases related to green claims and influencer marketing.
The most significant domestic competition law developments were discussed by dr. Gábor Gál, a member of the GVH competition council, summarized it. Dr. Gábor Gál, competition council member, highlighted that
“It can be a challenge for companies to follow and apply the current consumer protection regulatory changes. The GVH pays special attention and conducts active law enforcement activities, among other things, for the enforcement of price communication rules, as well as in the field of dark patterns, green claims and influencer marketing spread in the digital space. In connection with antitrust/cartel cases, he emphasized the importance of genuine leniency cooperation, and in connection with company mergers, he highlighted the newly introduced simplified form, and also reminded of the enforcement ban.”
“The rules are getting stricter for dominant businesses. Based on the European Commission’s draft of new guidelines, exclusivity agreements and discounts granted for exclusivity will presumably be illegal. The draft regulation can be commented on until the end of October in the framework of the ongoing public consultation.”
