The GVH cracked down on illegal e-cigarettes

The Economic Competition Office (GVH) imposed a HUF 189 million fine on the Slovak company Airbox, as it created a false impression among consumers that it legally distributes electronic cigarettes and smoking devices in Hungary, despite the ban on distance sales. According to the announcement of the GVH, the Slovak company engaged in deceptive commercial practices on its Hungarian-language website between June 2022 and February 2024.

GVH initiated proceedings against Airbox in February 2024, after noticing that the company’s Hungarian-language website probably misrepresents the marketability of its products. In Hungary, according to the legislation, the distribution of flavored electronic cigarettes and devices imitating smoking is prohibited, and the online distance selling of such products is also illegal. The competition authority found that Airbox engaged in unfair commercial practices, and therefore imposed the maximum possible fine on the company.

In order to protect consumers, the GVH ordered the blocking of access to Airbox’s website in Hungary immediately after the initiation of the procedure. The competition authority has the power to block certain digital content, such as websites, if necessary in view of the extensive involvement of consumers, in order to prevent the risk of serious harm. This expanded authority enables the GVH to act effectively in protecting the interests of consumers.

The GVH has previously taken strict action against two other Slovak companies that illegally marketed electronic cigarettes, including Elf Bar products popular among minors. These procedures also ended with the highest possible fine.
