This is how the rules on the inheritance of agricultural land changed
From January 1, 2023, new, special regulations came into force based on a law adopted in 2021.
The new regulation, effective from January 1 of this year, applies only to legal inheritance and divides it into two, if it is a property owned exclusively by the testator, and if the subject of the bequest is an ownership share in an undivided jointly owned property. If, according to the rules of legal succession, several heirs would inherit the property exclusively owned by the testator, then during the probate process, the co-heirs can also prevent the creation of undivided common property by dividing the property. In view of the specialty of the inheritance and probate procedure, the current amendment establishes different rules for the case where co-heirs and non-co-owners share the property than for the division between co-owners. – writes nak.hu.
This is to be done if there are several heirs at the same time
Another type of inheritance method is when the property share in an undivided jointly owned property is the object of the bequest and is inherited jointly by several co-heirs according to the rules of legal inheritance. In such a case, the co-heirs can choose from three options, thus avoiding further division of the ownership share:
– by class agreement: in this case, the share of ownership in the property classified as land is acquired by an heir,
– the ownership share in the property is sold together,
– the ownership share in the property is also offered free of charge to the state.
If neither option is chosen, it must be sold within 5 years after the end of the inheritance process, or the land ownership must be given to an owner, or the land must be relinquished in favor of the state. If this is not done, a forced sale will be ordered.
