We can wait months for a defective product to be repaired – what can the consumer do in such a situation?
The National Federation of Associations for Consumer Protection (FEOSZ) in Hungary is receiving a growing number of complaints about long delays in the repair of faulty products under warranty. Many consumers report having to wait weeks—or even months—before companies fulfill their legal obligations. While businesses cite various reasons, the law is clear: consumers have rights, and they should know how to enforce them.
Common excuses include: “We’re waiting for a part,” “The manufacturer hasn’t approved the replacement,” “We need to wait for the manufacturer’s response,” or simply “It’s peak season and we have no capacity.” In some cases, no response is given at all, even weeks after reporting the issue.
How long is the warranty period?
Mandatory warranty periods depend on the purchase price:
-
HUF 10,000 to 250,000: 2 years
-
Above HUF 250,000: 3 years
The warranty period starts on the day the consumer receives the product, or—if installation is required—on the day of commissioning.
Importantly, the warranty period is extended by the time the consumer is unable to use the product due to the fault.
The consumer decides where to file a complaint
Warranty claims can be submitted at the company’s head office, any branch or service point listed on the warranty document. The consumer cannot be passed around—they are free to choose where to submit their claim.
When must the product be replaced?
The law sets out strict deadlines:
-
If during the first repair attempt it turns out the product is unrepairable, it must be replaced or refunded within 8 days.
-
If the product breaks down three times, the company must also replace or refund it within 8 days.
-
If the repair is not completed within 30 days of notifying the company, it must be replaced or refunded within 8 days after the deadline expires.
Exceptions apply to certain vehicle types
These rules do not apply to the following products:
-
Electric bicycles, scooters, quads
-
Motorcycles, mopeds
-
Passenger cars, motorhomes, trailers
-
Motorized watercraft
Know your rights—and use them
In 2024, 126 official proceedings were launched in Hungary over warranty-related complaints, and violations were confirmed in 73 cases. This shows that warranty violations are common, and consumers should be informed and assert their rights under the law.
