NAK also provides assistance to its members in land matters
The National Chamber of Agrarian Economy (NAK) pays special attention to tasks related to land issues. Members can also contact the chamber’s experts with questions about land matters, who provide free advice. In addition, NAK also takes an active role in the legislative process in the field of land transfer regulation.
In order to protect the interests of local farmers and to achieve the general agricultural and land tenure policy goals set out in the Land Transfer Act, the National Chamber of Agrarian Economy carries out its land affairs activities as a task of special importance year after year. Both central and county level highly qualified specialists are at the disposal of the membership, so farmers can receive valuable advice on general or specific land matters, of course free of charge.
An important part of NAK’s land activities is the role defined in the Land Transfer Act in the official procedure aimed at approving agricultural land sales, exchange and lease contracts
The Land Traffic Act specifies that these tasks are carried out by the NAK through its territorial bodies according to the location of the given land, i.e. the local land commissions. In order to fulfill this task, in the past year, the NAK 19 county presidency held 750 land committee meetings with a frequency of one or two weeks based on local customs. A total of 57,079 cases were decided at these meetings. 3,056 out of 3,155 Hungarian settlements were involved in these cases, with a total of 81,697 parcels of land. According to the current procedure, the requests received from the land office, after processing, are forwarded by the staff of the county land network – often with the help of the village farmer network – to the managements of the Settlement Agricultural Committees (TAB) for a preliminary opinion. There are currently 2,373 TABs operating in connection with the Chamber, covering all settlements in the country. In the past year, 97 percent of the examined contracts were supported by the local land commissions.
Land transactions also include acquiring the right to use land
Since July 2022, NAK has been participating in the review of lease agreements. If the county board deems that the rent is disproportionately high compared to what is customary in the area, it will notify the land office with a reasoned statement. In the past year, the county presidencies of Kamara examined 44,861 lease contracts and in 295 cases sent a statement to the land office. In order to successfully implement all these land-related tasks, NAK’s land-related network receives continuous professional training, and they receive up-to-date information on legislative changes and legal interpretation issues. The membership also receives continuous information about changes in the legal environment through NAK’s publications and thematic informative articles, which contain explanations and practical examples in connection with the regulation and its changes.
