Can I secretly record what was said at the business meeting?
As technology advances, it becomes easier to record any conversation. Today, anyone can easily record business negotiations with a smartphone – even secretly. There can be countless reasons for making a secret recording: for some, it can be a security measure to avoid later disputes, and others want to use it later with some ulterior motive. But is it legally permissible to secretly record audio? And what are the consequences of using a secretly recorded audio recording in a civil or criminal proceeding? The protection of personal rights is of fundamental importance. The Civil Code therefore expressly states that the consent of the persons concerned is required for the production and use of all audio recordings. If someone makes or uses a sound recording in an unlawful manner, they may even be required to pay damages.
Consent can be express, written or verbal consent, or even conduct that makes it clear that the other party is not opposed to the recording. However, it is important that consent to recording does not automatically mean consent to use, for example disclosure.
