EU: the application of international law is also an obligation in cyberspace
The Council of the European Union approved a statement on the common interpretation and obligation of the application of international law in cyberspace, in which the member states stated: cyberspace is not an area outside the law, the EU Council announced on Monday.
The Brussels communication drew attention to the fact that a better global common understanding of the application of international law to cyberspace contributes to increasing the global resilience of cyberspace, as well as to further transparency, predictability and accountability of states’ behavior in cyberspace.
In this spirit, the EU and its Member States continue to support non-EU countries through training and capacity building on the implementation of the UN Framework for Responsible State Behavior in Cyberspace, including how to develop a national, regional or international position on the application of international law to cyberspace in connection
– they wrote.
The statement indicates that international law is still valid in the digital field, states must comply with certain rules and obligations when conducting activities in cyberspace, it was highlighted.
The statement recognizes that malicious behavior in cyberspace, including the distribution of ransomware, is increasing in scale, severity, sophistication and impact, posing a significant challenge and threat to the functioning of European societies and economies.
Therefore, respect and adherence to the UN framework for responsible state behavior in cyberspace remains essential for the maintenance of international peace, security and stability
– stated and then underlined: the EU and its member states confirm their commitment to the implementation of the UN framework for responsible state behavior in cyberspace.
The framework confirms, among other things, that international law, especially the UN Charter, international human rights norms and international humanitarian law, fully applies to cyberspace, they pointed out.
