Hotels take the responsibility for the cars left in parking lot
If it is determinable that the parking lot belongs to the area of the hotel, the cars placed there are under the responsibility of the hotel without any special agreement – stated the Supreme Court.
In the specific case; an Austrian
citizen’s car has been stolen, from the hotel’s parking lot. The
area was a parking lot belonged to the hotel, with lockable gates and
surrounded by fence, and identified as a guarded car park in the
hotel’s brochure. The victim's insurance presented an insurance
claim against the hotel, which was found to be legitimate by the
court, since the hotel has not provided the guarding of the car park
right.
