The Hungarian Competition Authority (GVH) has imposed a fine of 352 million forints on the legal successor of Vodafone Hungary Zrt., One Hungary Zrt., because Vodafone did not properly inform consumers about the application of the inflation-tracking fee adjustment between October 2022 and May 2024, the authority told MTI on Friday.

The investigation showed that Vodafone introduced the inflation fee adjustment based on the amendment to its GTC that entered into force on August 8, 2022, which was first implemented on January 1, 2023. applied.

Although the telecommunications legislation allowed for the automatic inflation rate correction to be applied, even in the case of loyalty contracts, the GVH considered that the company’s information practices did not comply with consumer protection regulations.

Vodafone advertised its loyalty contracts in such a way that it often included the monthly fee, without clearly indicating the possibility of a price increase.

The authority emphasized that consumers could conclude new loyalty contracts based on the advertisements believing that the monthly fees would remain unchanged during the entire loyalty period, while the contractual terms allowed for an annual inflation-tracking fee increase.

As stated, the Competition Council assessed as a mitigating factor when determining the amount of the fine that One Magyarország Zrt. cooperated with the GVH, acknowledged the violation, waived its right to legal remedy, and terminated the objectionable commercial practice from May 2024.
