The GVH imposed a fine of 100 million forints on the company distributing GymBeam nutritional supplements
GymBeam communicated deceptively, and therefore a fine of 100 million forints was imposed on the company that distributes nutritional supplements, the Hungarian Competition Authority (GVH) told MTI on Tuesday.
The Hungarian Competition Authority launched competition supervision proceedings against GymBeam s.r.o. and its Hungarian subsidiary GymBeam Hungary Kft. at the end of 2022, as the company was suspected of engaging in unfair commercial practices against domestic consumers in several respects, the statement said.
According to the information, the national competition authority determined during the proceedings that the company’s commercial practices were indeed unlawful in several respects.
In the product descriptions displayed on its website, the company often claimed beneficial health effects or medicinal effects that either did not meet legal requirements or were outright prohibited.
By using crossed-out prices between May 1, 2022 and November 7, 2023, and by publishing the slogan “best prices”, it falsely suggested to consumers that they could purchase certain products at a discount, and starting from May 28, 2022 – despite the legal requirement – it did not display certain information regarding the management and filtering of consumer reviews – it was explained.
The authority stated that the Competition Council of the Hungarian Competition Authority found, in addition to the violations, that GymBeam’s communication practices overall did not meet the requirement of professional diligence, and the company did not ensure that large-scale and systematic problems similar to the listed violations did not occur.
Several products were distributed without the company having previously reported them to the competent authorities.
