GVH imposed a fine of 235 million forints on eMAG Magyarország Kft.
eMAG Magyarország Kft. engaged in unfair commercial practices and did not adequately inform Hungarian customers, therefore the Hungarian Competition Authority (GVH) imposed a fine of 235 million forints on the company operating the web store – the GVH told MTI on Friday.
According to the announcement, the GVH launched competition supervision proceedings against the Hungarian company operating the eMAG web store in February 2024. In the proceedings, the office revealed that the Romanian-based company engaged in unfair commercial practices that were unlawful in several respects.
The Competition Council of the GVH found, for example, that the e-commerce company advertised numerous products in the fashion category on its website and app with unrealistic discounts during its “Crazy Days” campaign between 25-28 July 2023. Furthermore, that from 31 October 2023, it did not act in accordance with the requirement of professional diligence when developing its information practices regarding the (expected) delivery times of the products.
In addition, they pointed out that from July 22, 2023 to April 2024, the e-commerce company displayed the legally required 14-day right of withdrawal and warranty rights of consumers on its website and mobile application as a feature (advantage) of the company’s offer for certain products. In addition, from April 17, 2024, it displayed delivery and cash on delivery costs on its website and application in an incomprehensible and untraceable manner.
They added that the GVH also investigated the practice of moderating consumer reviews of the company operating eMAG. In this regard, the office did not establish a violation of the law, but obliged the company to implement its commitment. This is aimed, among other things, at revising the evaluation rules, applying them more consistently and enabling the evaluation of sellers (delivery).
According to the announcement, the company cooperated with the GVH during the procedure, acknowledged the violations discovered and waived its right to legal remedy. Taking all this into account, the GVH Competition Council imposed a fine of 235 million forints on the company, which it must pay into the Hungarian central budget within 30 days.
The GVH also ordered eMAG to develop and implement a general consumer protection compliance program, as well as to further develop the system of delivery estimates and information related to delivery deadlines, and to make the indication of the cash on delivery fee clearer.
It was also pointed out that this was not the first time eMAG had come under the GVH’s scrutiny, as the Hungarian national competition authority had previously fined the company and its predecessors on several occasions for price-related violations.
In addition, it is important that the GVH In February 2025, the office launched another follow-up investigation against the operators of the eMAG web store, and the procedure is currently ongoing, the office announced in its statement.
