OKSZ issued a statement in the case of János Lázár vs Fanta
The National Trade Association rejects the totally unfounded accusations of János Lázár in the position of the Minister of Construction and Transport, concerning the traders, which otherwise arose in connection with the Coca Cola product. Due to the nature of the topic, we have to divide our comments into two parts.
The domestic “food law” ensures that only safe foods are placed in the shopping carts, that consumers receive adequate information, and that they are not misled regarding the composition and characteristics of the foods sold. Food manufacturers and processors have the right to modify the composition of their products so that they comply with e.g. to national legislation, local consumer preferences or differences resulting from geographical and/or seasonal availability as long as all requirements of EU food and consumer protection legislation are complied with. Manufacturers cannot mislead the consumer by claiming that food products produced under the same brand are identical in all respects to products marketed in other EU countries, when this is not true, because, for example, they are different in composition.
We can therefore speak of “double quality” if a food placed on the market in Hungary and a food placed on the market in at least one other member state are the same (identical), but their composition or characteristics differ significantly and these significant differences are not justified by “legitimate and objective reasons”. Thus, we cannot speak of double quality if a significant difference between the products can be explained by legal and objective reasons, for example, the use of taurine is subject to a special tax or the use of sugar cane can be substituted, but if it can be justified, domestic taste preferences can also be taken into account. If a “suspicion of double quality” arises, it can only be established as a result of complex investigations involving the stakeholders.
Addressing the commercial companies named in the post is completely incomprehensible and unjustified, since the manufacturer’s brand, which was brought into the news in connection with the “double quality”, is sold in the entire country, starting from small village shops and hypermarkets.The Association respectfully, but at the same time, firmly rejects the generalization regarding the quality of the products sold, as the member companies involved are constantly striving to sell food products to the satisfaction of consumers in accordance with the relevant legislation and taking into account customer expectations. The retailer does not decide on the composition of a manufacturer’s brand, such as Fanta, and has no direct influence on it anyway.
